What Is Civil and Commercial Mediation?

Mediation is a voluntary and confidential process in which an impartial mediator assists those involved in a dispute to explore whether an agreed resolution can be reached.

The mediator manages the process and facilitates communication and negotiation. The mediator does not act as a judge, impose a decision or provide legal advice.

Mediation may take place before court proceedings begin or while proceedings are ongoing. It can be used for a single issue or a complex dispute involving several parties and competing interests.

How the Mediation Process Works

1. Initial Enquiry

Contact Resolvu with brief details of the dispute. We will explain the process, identify the participants and consider whether the matter appears suitable for mediation.

2. Arrangements and Preparation

Once the participants agree to mediate, we will arrange the date, format and duration of the mediation. The participants will receive the mediation agreement and information about any documents or case summaries required.

3. The Mediation

The mediator will explain the process and speak with the participants in joint or separate meetings as appropriate. Each participant will have an opportunity to explain their position, identify their concerns and consider possible options.

4. The Outcome

If terms are agreed, the participants and their legal advisers may record them in a written settlement agreement. If no agreement is reached, the participants remain free to consider their other options.

The Mediator’s Role

The mediator remains impartial and does not decide who is right or wrong. The mediator supports the participants by:

Online and In Person Mediation

Online mediation allows participants and their advisers to attend from different locations using secure private meeting rooms. In person mediation can be arranged where this is appropriate and practical.

Frequently Asked Questions

Do I need a solicitor?

A participant can attend mediation with or without a solicitor, depending on the nature of the dispute. The mediator cannot provide legal advice, so participants may wish to obtain independent legal advice before making decisions or concluding a settlement.

Will I have to speak directly to the other participant?

Not necessarily. The mediator can use joint meetings, separate private meetings or a combination of both. The format will be considered in light of the dispute and the needs of those involved.

Is mediation confidential?

Mediation is conducted privately and is subject to the confidentiality provisions within the mediation agreement. Confidentiality is not absolute, and any applicable exceptions will be explained as part of the process.

Can the mediator impose a settlement?

No. The mediator facilitates communication and negotiation but does not impose an outcome. Each participant decides whether to settle and whether the proposed terms are acceptable.

What happens if no agreement is reached?

If the dispute is not resolved, the participants remain free to pursue or defend proceedings, continue negotiations or consider another form of dispute resolution.

How long does mediation take?

The duration depends on the nature, value and complexity of the dispute. Some matters are suitable for a shorter session, while more complex disputes may require a half day, full day or further session.
